* Standard minimum rental period is 3 days.
* During peak holiday periods (Easter & Christmas), the minimum rental period is 5 days.
* Reservations shorter than 5 days are accepted only within 7 days before your arrival, subject to vehicle availability.

* The rental period starts and ends at the time stated in your booking confirmation.
* Returning the vehicle earlier than agreed does not qualify for a refund.
* Late returns may result in additional charges.
* Vehicle collection or return on January 1st is available only by prior arrangement and is subject to an additional fee. Failure to arrange this in advance may result in cancellation of the rental.

* Only drivers listed in the rental agreement may drive the vehicle.
* Drivers must be between 28 and 70 years of age.
* All drivers must hold a valid driving licence.

*Drivers must have held a full, valid driving licence for a minimum of 2 years prior to the start of the rental.

Airport

* Malaga Airport delivery and collection is always FREE.

Hotels & Apartments

* For rentals of 5 days or more, delivery within:
* Malaga
* Torremolinos
* Benalmádena
* Fuengirola
* or any location within 15 km (accessible by public transport)
is FREE.
* For rentals of 3–4 days:
* Delivery: €20
* Collection (if requested): €20

Some premium vehicles require a refundable security deposit, which is returned on the same day after the vehicle has been inspected and returned in satisfactory condition.

Vehicles that do not require a security deposit are subject to a €250 insurance excess (deductible).

This amount is not paid in advance. It becomes payable only if the driver is personally responsible for damage to the rental vehicle (at-fault accident or damage caused through negligence or breach of the rental agreement).

If the accident or damage is not the driver’s fault, or it is fully covered by the insurance under the terms of the rental agreement, no excess is payable.

The vehicle must be returned with the same fuel level  and type as received.

* Unlimited mileage applies for short-term rentals within ANDALUSIA ONLY!
* Long-term rentals (28+ days) include 2,500 km per month.
* Travel to Portugal or any country outside mainland Spain is strictly prohibited.
* Travel to Gibraltar is permitted.
* All vehicles are equipped with GPS tracking for security purposes.

Penalty for breaching geographical restrictions is €190

Vehicle delivery or collection between 00:00 and 06:00:

* €80 service fee
* Available only for rentals of 5 days or more

Full insurance is included with every rental, subject to compliance with these Terms & Conditions.

Driver Eligibility

* Only drivers aged 28 to 70 years are permitted to rent and drive our vehicles.
* Drivers under 28 years of age are not accepted under any circumstances, including with an additional fee, due to the requirements of our insurance provider.
* Drivers over 70 years of age are not eligible to rent or drive our vehicles.
* Only drivers named in the Rental Agreement are insured and authorised to operate the vehicle.
* All drivers must hold a valid driving licence.
* Drivers whose driving licence was issued outside the European Union (EU) must present both their original driving licence and a valid International Driving Permit (IDP) when collecting the vehicle. Failure to provide the required documents may result in the rental being refused without refund.

Insurance Cover
Insurance is valid only when:

* the vehicle is used in accordance with these Terms & Conditions;
* any accident, theft, vandalism or damage is reported to Malaga Drive Rental immediately;
* all required accident reports and supporting documentation are completed and submitted;
* the driver complies with all applicable traffic laws and legal requirements.

Insurance Exclusions
Insurance does not cover:

* ⁠Lost or damaged keys.
* ⁠Tyre punctures or tyre damage.
* ⁠Incorrect fuel.
*⁠ ⁠Damage caused by negligence, misuse, reckless driving, driving under the influence of alcohol or drugs, or any breach of these Terms & Conditions.

For vehicles without a security deposit, a €250 insurance excess (deductible) applies. This amount is not payable in advance and will only be charged if the driver is personally responsible for damage to the rental vehicle due to an at-fault accident, negligence, or breach of the rental agreement. If the damage is not the driver’s fault and is covered by the insurance policy, no excess is payable.

For selected premium vehicles, a refundable security deposit is required. The deposit is refunded on the same day after the vehicle has been inspected and returned in satisfactory condition.

The following are strictly prohibited:

* Smoking inside the vehicle.
* Drinking alcoholic beverages inside the vehicle.
* Eating inside the vehicle.
* Driving under the influence of alcohol or drugs.
* Off-road driving.
* Racing or dangerous driving.
* Towing another vehicle.
* Commercial use.
* Carrying more passengers than permitted.
* Allowing unauthorised drivers to operate the vehicle.

Any breach of these conditions makes the renter fully responsible for all resulting damages and costs.

In case of an accident, breakdown, theft or vandalism:

* Contact Malaga Drive Rental immediately.
* Contact the police where required.
* Complete all necessary accident documentation.
* Take reasonable steps to protect the vehicle.

The vehicle must be returned:

* on time,
* clean,
* in the same condition as received,
* with all accessories, keys and documents.

Tyre punctures are the renter’s responsibility. In accordance with Spanish safety regulations, tyres must be replaced in matching pairs with the same tread or replaced with an identical tyre specification.

• Child seats are available upon request. We are happy to assist with installation; however, the renter is solely responsible for ensuring the child seat is correctly installed and the child is properly secured.
• Malaga Drive Rental is not responsible for any personal belongings left inside the vehicle.
• The renter is responsible for all traffic fines, parking penalties, toll charges, and any associated administrative fees incurred during the rental period.

• Malaga Drive Rental reserves the right to terminate the rental agreement immediately, without refund, if the renter breaches these Terms & Conditions.
