TERMS AND CONDITIONS

1. Rental Period:

The rental period begins and ends as specified in the agreement.
Late returns may incur additional charges.

2. Driver Requirements:

Only authorized drivers listed in the agreement are allowed to operate the vehicle.
Drivers must meet minimum age and licensing requirements.

3. Reservation and Payment:

Reservations are subject to vehicle availability.
Payment is due at the start of the rental period.

4. Security Deposit:

A security deposit is required to cover potential damages and is refunded upon safe return of the vehicle.

5. Fuel Policy:

The vehicle must be returned with the same level of fuel as when rented.

6. Mileage Limitation:

The rental includes unlimited mileage, allowing you to travel without restrictions within the agreed-upon rental period.

7. Maintenance and Repairs:

The company covers the cost of regular maintenance.
The renter is responsible for any damages resulting from misuse.

8. Insurance:

Full insurance is included.

9. Prohibited Activities:

Smoking, pets, and off-road use are strictly prohibited.

10. Accidents and Breakdowns:

In case of an accident or breakdown, contact the company immediately.

11. Return Condition:

The vehicle must be returned in the same condition as when rented.

12. Penalties:

Penalties may apply for violations of terms and conditions.

Terms and Conditions Contract Duration: The rental period is as stated in your rental agreement, including the specified date and time for vehicle pickup and return. If you return the vehicle before the agreed-upon date, no refund will be provided for the unused rental days. Vehicle Use: As a renter, you agree to: – Drive the vehicle responsibly, following all traffic laws and road signs. Any damage resulting from negligence or failure to adhere to traffic rules will not be covered by insurance. – Refrain from driving under the influence of alcohol, drugs, or any substances that impair your ability to drive safely. Allowing someone else to drive under these conditions is also prohibited. – Ensure that only authorised drivers listed in the rental agreement operate the vehicle. – Avoid using the vehicle for illegal activities, transporting more passengers than the vehicle is designed for, or transporting animals. – Do not use the vehicle to tow other vehicles, participate in races, or test automotive products. – Use only the fuel type specified by the vehicle manufacturer. – Keep the vehicle locked and parked safely when not in use. – Do not modify the vehicle in any way, including the installation of unauthorised equipment such as roof racks. – Do not use the vehicle for commercial purposes, public transportation, or driving lessons. Vehicle Return: The vehicle must be returned to the agreed location, on the specified date and time, in the same condition it was received. This includes all documents, equipment, tires, tools, and accessories. Any unauthorised modifications or alterations will require you to cover the cost of returning the vehicle to its original condition. Payments: You agree to pay Malaga Drive Rental: – At the start of the rental period using a debit or credit card, cash or bank transfer. – For any fines or penalties incurred during the rental period due to improper parking, traffic violations, or other infractions. – For any loss, damage, or deterioration of the vehicle, including but not limited to windshields, mirrors, keys, tires, and interior damage. The maximum cost for such damages is capped at €500. – For repair costs if the vehicle is damaged in an accident and was not used according to the rental agreement, or if the accident report is not completed accurately and submitted on time. Fuel Policy: You are required to return the vehicle with the same fuel level it had at the beginning of the rental period. Insurance: You and any authorised drivers are covered under the vehicle’s insurance policy, which includes liability for third-party damages. Coverage includes collision, theft, fire, and vandalism under the following conditions: – The incident is reported to Malaga Drive Rental within 24 hours, along with all necessary documentation, including a completed and signed accident report. – The insurance claim is not rejected due to the driver failing to meet physical or mental conditions required by law. – The incident did not occur due to misuse of the vehicle. Insurance does not cover damage to tires, rims, mirrors, windows, locks, the vehicle’s underside, or costs associated with key loss, towing, or fuel errors. Additional insurance to cover these risks is available but only applies if you comply with all rental terms. Accidents and Incidents: In the event of an accident, you must: – Collect detailed information from all parties involved, including witnesses, and document the accident with sketches and vehicle details (license plates, model, insurer, etc.). – Notify Malaga Drive Rental immediately and provide all relevant details. – Contact the authorities if required, especially if injuries are involved. – Take all necessary measures to protect and safeguard the vehicle after the incident. – In case of fire, vandalism, theft, or disappearance of the vehicle, report the incident to both Malaga Drive Rental and the relevant authorities immediately. Misuse of the Vehicle: You are required to maintain the vehicle in good condition and use it responsibly. Misuse includes, but is not limited to: – Driving under the influence of substances that impair your ability to drive. – Reckless driving or violating traffic laws. – Using the vehicle for illegal purposes or allowing unauthorised drivers to operate the vehicle. – Using the vehicle after the rental period has ended. – Transporting more passengers than allowed or using the vehicle to transport animals. – Towing other vehicles or using the vehicle in competitions or tests. – Using the wrong type or quality of fuel. – Leaving the vehicle improperly parked or unlocked. – Leaving valuables visible inside the vehicle. Driving License: You must hold a valid driving license. You are responsible for ensuring the validity of your license. Child Seats: If you require a child seat, you must notify Malaga Drive Rental. You are responsible for the correct installation and use of the seat. Malaga Drive Rental is not liable for any injuries or damages resulting from improper use or installation of the child seat. Right to Cancel: Malaga Drive Rental reserves the right to terminate the rental agreement immediately and without compensation in the following cases: – If there are serious doubts about your financial solvency. – If you breach the rental agreement. – If you misuse the vehicle. Traveling: You are not allowed to leave Spain (mainland) UNDER ANY CONDITION except for travelling to Gibraltar. Vehicle has a GPS tracking system for security and maintenance, which you agree to by using the vehicle. Data will be managed in line with data protection laws. Personal Belongings: Malaga Drive Rental is not responsible for any personal items that are stolen, lost, or forgotten in the vehicle.
